ALLEN HODGE

(1790-1835)

 


Allen Hodge, a son of Henry Hodge and Catherine Bryant, was born ca. 1790 in the Scotland Neck-Kehukey Creek area of Halifax County, North Carolina. He and his brother James were well educated in Halifax County prior to the family's movement to the Claylick Creek area in 1804 (see 1802 receipt below). A lawyer and farmer by trade, he attended the early court at Salem along with his older brother James. Both Allen and James conducted much of their father's legal affairs in Livingston County and travelled to Edgecombe County on numerous occasions when involving the estate of their uncle Thomas Hodges Esq.  Allen is shown in the 1811 Livingston County Tax Rolls with two slaves and one horse near Claylick Creek. He married Sarah Campbell, daughter of James Campbell Sr. and Jeane Victore De La Porte of Petersburg, Rockbridge County, Virginia. Sarah's brothers were Judge James Campbell that married Judge Dickson Given's daughter Mary and the Rev. Wheeler Campbell of Salem that later moved to Paducah, McCracken County, Kentucky. In the 1816 Livingston County Tax Rolls he is listed with 116 acres on Claylick Creek, by 1820 he had greatly increased his wealth to nine slaves. In the 1820 Livingston County census for the town of Salem Allen had listed in his household: one male under 10; two males 16 to 26; one male 26 to 45; one female under 10; one female 16 to 26; one person engaged in commerce and a total of 9 slaves. Allen received a land grant of 12 acres on Claylick Creek that was surveyed on February 1, 1822 (Bk. L, p. 507). He and Sarah had the following known children before her death prior to November 1826: Eliza, Julia Allen, and Emily.

 

In 1826 Allen was in Edgecombe County, North Carolina where he entered into a marriage contract with Mary Brady (DB 18-544; dated Nov. 5, 1826). According to the Raleigh Register and North Carolina State Gazette they were married November 24, 1826 in Edgecombe County. Also, in the newspaper, Tarboro Free Press, Tarboro, NC, Nov. 14, 1826, is found: Married on Nov. 7, by William E. Bellamy, Esq., Allen Hodge of Kentucky to Mary Brady of Edgecombe County.This is the first of two marriage contracts involving Mary Brady. Allen and Mary had the following children: Mary Louisa, Richard, Ruffus and James. She was the daughter of Edgecombe County planter Job Brady. In 1796 Edgecombe County deed records her father is listed as Job Braddy and living next to Zacheus  Hackney, Jack Moore Hackney and James Weeks on the southwest side of Gum Swamp.

In the 1830 Federal Census for Livingston County, Allen is listed living in the town of Salem. Those living in his household were one white male under 5, one white male 20 to 30, one white male 30 to 40, one white female under 5, two white females 5 to 10, and one white female 20 to 30. He was living next to his cousin Blount Hodge, two houses up from Joseph Watts (husband of his niece Lucinda D. Haynes & later guardian to his daughter Julia Allen), three houses up from his brother James Hodge and four houses up from his cousin Berry Hodge. Fidelio Thomas Hodge, Allen’s nephew, stated in the genealogy book by Orlando John Hodge that Allen died in 1835. It is apparent that he died intestate and from the court record Joseph Watts was appointed guardian to his daughter Julia Allen in 1836.

In 1836 Allen’s widow, Mary Brady Hodge, married Mark Phillips (b. 3 June 1778; d. 30 June 1837, Salem, Livingston Co., Ky.). Their marriage involved a detailed contract in which he agreed to raise her children as his own. Unfortunately he died less than a year after the marriage. He is buried at Mills Pioneer Cemetery just south of Salem. Mary was forced to go file suit in Livingston County Circuit Court to get the land in which Mr. Phillips had set aside for her in the marriage contact. With so many legal problems entailed, Mary decided to conduct her own business affairs in her own name. This was indeed quite a feat during that period. On April 19, 1842 she married John H. Wood (b. Apr. 4, 1793, Greenville, SC.; d. Aug. 13, 1858, Smithland, Livingston Co., Ky.) of Christian County, Kentucky. He was the son of Capt. Harry Wood. John lived and farmed near Smithland until his death in 1858 of consumption. He is buried at the Smithland Cemetery which overlooks the sleepy river village of Smithland. In his will he left wife Mary, during her natural life, household and kitchen furniture (except one bed and bedding and secretary), farming utensils, hogs, cattle and cart. In the 1860 census his widow Mary is living on the farm near Smithland with her son James Hodge and his wife Virginia (Elizabeth A. “Jenny” Warmack). She was enumerated in the 1870 and 1880 census at Smithland. Her death was posted in the Crittenden Record Press on August 31, 1881- Smithland: Mrs. Mary Wood died on the 25th inst.

 

Eliza Jane Hodge was born circa 1818 at Salem, Livingston County. In 1835 she married George W. Robertson. William Pippin, then a justice of the peace at Salem, married them. The marriage bondman was her stepfather Mark Phillips. Eliza was enumerated in the 1850 Livingston County census as head of household. George had died some 5 weeks before the census was taken. Listed in the household was Eliza, her six children: James T., George Ann, William W., Robert C, Martha H., Willis Harrington and William Furgerson (Ferguson)-laborer. On February 24, 1852 in Livingston County Eliza married her second husband Hugh Alexander Hinton. They would have one child, Margaret, he would died sometime before 1860. She was living in the Dyer Hill Precinct in 1870. Those listed in her household where herself, age 50;  Maggy Hinton, age 16; T. Robertson, age 30; William W. Robertson, age 19; Ann Robertson, age 25; Coria (?) Robertson, age 7; and D. Alsobrook, domestic servant.

 

Julia Allen Hodge was born July 26, 1819 at Salem, Livingston County. In 1836 Joseph Watts was appointed guardian of “Julia Allen Hodge heir of Allen Hodge being over 14 years of age” [Livingston Co. Ct. Order Book I]. That same year she married Dr. James Patterson Holt. They later moved to Calloway County, Kentucky where he practiced medicine until his death in 1879. They had two sons who became lawyers, Gustavus and Oscar. Their sons Gustavus, James, Oscar and Henry enlisted in the Confederate Army at the outbreak of the Civil War.

AFFRAY.
An affray occurred in our town, on Saturday last, between Col.
Jesse Leigh and Dr. J. P. Holt, which created for the time very great
excitement. The parties met near the Pavilion, (whether by accident or
design, we know not) and a serious and very threatening engagement followed.
Col. Leigh burst the cap of his pistol at Holt's breast, but the pistol
missed fire. Leigh then struck Holt with his pistol, and in the engagement
both parties got to the ground. During the engagement Dr. H. fired his
pistol, having it almost touching Leigh's head, but fortunately missed him.
We are truly gratified that, although the encounter was fearful in its
aspect, no serious injury was inflicted by either. Both parties were
immediately brought before the circuit court of our county, then in session,
and recognized in the penalty of $1,000 for their good behavior for the next
six months.

 

Gustavus Adolfus Christian Holt would later serve as the commander of the famous “Orphan Brigade”. Gustavus continued his practice after the war and in 1868 he married his cousin Ina Louise Berry. Ina was the daughter of Cuthbert Berry and Mary Hodge. Sometime after 1880 he opened up a law office in Memphis, Tennessee and was a resident there until his death in 1910. 

 

James F. Holt enlisted as a Private with Company F, First Kentucky Infantry Regt. (CSA) on Apr. 26, 1861 at Murray, Ky. On July 5th of that year he enlisted with Company H, 3rd Regiment Kentucky Cavalry at Camp Boone, Tennessee. He was last listed in the rolls on June 11, 1863 as a deserter.

 

Oscar Holt enlisted as a Private with Company F, First Kentucky Infantry Regt. (CSA) on Apr. 26, 1861 at Murray, Ky. He was mustered out of the 1st Infantry at Richmond, Virginia on May 14, 1862 and enlisted with Company F, 3rd Regiment Kentucky Cavalry and was captured at Fort Henry, Tennessee on August 1, 1862. He took the oath and bond for alligence to the U.S. on October 16, 1862 and returned home. He lived and practice law in Calloway County until his death in 1900.

 

Henry C. Holt enlisted in Company H, 3rd Regiment Kentucky Cavalry at Paducah, Kentucky on March 25, 1864 and was sworn in by his brother LtCol. G.A.C Holt. He was captured in Calloway County, Kentucky on November 18, 1864 and sent to Camp Morton, Indianapolis, Indiana. He enlisted in the U.S. Army on March 24, 1865.

Emily Hodge was born September 24, 1821 at Salem, Livingston County. She married in 1846 to William B. Rudy. William farmed for several years in Henderson County, Kentucky. In about 1856 they moved to Lyon County, Kentucky where he died in 1860. Emily continued to live on the farm and around 1880 she moved in with her daughter Sarah (Rudy) Cox in Saint Louis, Missouri. She remained with her daughter until her death of senile debility on September 30, 1908 at age 86 years and 26 days. After her death she was taken to Henderson, Kentucky where she was laid to rest next to her husband.

Mary Louisa Hodge was born October 20, 1827 at Salem, Livingston County. She married her cousin Cuthbert Berry, son of Maria Hodge and John Berry. Cuthbert owned and operated a grocery store in Salem next door to his mother and her second husband William Pippin. In 1880 she and her son, Dr. Frederick Berry where living on a farm near Jefferson, Desha County, Arkansas.

 

Dr. Richard J. Hodge was born March 29, 1829 at Salem, Livingston County. He married his brother-in-law’s sister, Margaret L. Rudy, in 1852 at Henderson, Kentucky. He attended his first year of medical school at the University of Louisville in 1851. After medical school he practiced medicine in Smithland and then moved to Henderson where he died before May, 11 1857. Henderson County Court Order Book F, page 426, 11 May 1857: On motion of John Rudy, who took oath, it is ordered that he be appointed administator of Richard J. Hodge dec'd and with Wm. B. Rudy, his surety, executed bond. Page 427, 11 May 1857: L.F. Jones, P. Thompson and W.G. Offutt were appointed to appraise the personal estate and slaves, if any, of Richard J. Hodge. His widow Margaret is listed in the 1860 census in Lyon County, Kentucky in the household of her sister-in-law Emily (Hodge) Rudy. Margaret later moved back to Henderson, Kentucky and married William Young Mitchusson on Oct. 21, 1861. She died in 1863 and is buried in the Hodge family plot.

Dr. James A. Hodge was born June 8, 1834 at Salem. He married Elizabeth A. “Jenny/Virginia” Warmack[3] on November 30, 1858 at Smithland. The marriage was solemnized by James R. Dempsey and those attending the wedding were George Thrift, Samuel K. Green and bondsman James M. Patterson. Consent: “To the Clk…know by this that you are permitted to grant to Jas. A. Hodge License to marry my daughter Jenny. Nov. 30, 1858.” signed R.E. Warmack.

 

James, later referred to as Doc, attended his first year of medical school at the University of Louisville in 1849. He lived with his mother and helped run the farm until his completion of medical school and internship. After the Civil War he moved to Stoddard County, Missouri and where he continued his medical practice until around 1891 when he moved to Gayoso, Pemiscot County and formed a partnership with Dr. G.W. Tate. In the Nov. 6, 1891 issue of the Gayoso Democrat he and Dr. Tate are listed as Physicians and Surgeons of Gayoso.

 

From the research of a descendant, Garry Cassidy, Doc owned a hotel in Gayosa. He would carry a derringer while visiting patients to protect him from the wild animals, namely wildcats that would follow him in the woods jumping from tree to tree. Another family story handed down by Jennie Cassidy nee Sanders, was that her mother Augusta would sleep in the same bed as her grandmother when she was a baby in Stoddard County. As the story was related the grandmother was a Hodge that married an Indian. This may refer to Jenny Warmack, but the family is unsure and more research is needed.

 

Dr. Hodge was last listed in 1900 census at Gayosa with his daughter Augusta and her two sons. It is believed that he died at Gayosa sometime prior to the 1910 census.

  Prominent among Wednesday’s weddings was that of Miss Julia Emily Cox, eldest daughter of Mr. Charles Cox of Westminster place, and Mr. Harris Hancock Johnston, formerly of Louisville, Ky.; but recently removed to St. Louis. This was a house wedding, at 7 o’clock, at the handsome Cox home, which was elaborately arranged with flowers and greens. Each room was done in a distinct color – the Empire drawing room entirely in green and white roses; the library, a bower of bridesmaid roses, their rich pink thrown into relief by the mahogany woodwork; the halls with quantities of palms and ferns, and the dining-room in tall American Beauties. Here the table was artistic with ribbons, candelabra and roses, all of the deep American Beauty shade.

  At the chosen time the bride’s two little sisters, the Misses Sadie and Ethel Cox, formed an aisle from the library doors to the drawing-room bow window, with broad bands of white satin. Down this aisle came the bridal party – first the little ring-bearer, Master Douglas Cox, with the ring on a satin cushion; then the bride and groom, and lastly, the maid of honor, Miss Virginia Cox, and the best man, Mr. Stoddard Johnston of Louisville, a brother of the groom. The Rev. Dr. Holland of St. George’s Church officiated.

  The bride, who is a very pretty girl, wore ivory satin duchesse, en traine, high bodice, with long sleeves; shirred chiffon formed a yoke, with bertha of duchesse lace and a high Medici collar, lined with chiffon behind the hair. Her tulle veil was fastened with a diamond crescent and pearl pins, and she carried Carnot roses, combined with lilies of the valley, for her bouquet.

  The little maids were frocked alike in white tulle over white silk, low-necked and short-sleeved in extremely airy and dainty effect. They carried enormous showers of pink roses – all that each pair of little arms could hold. The ring-bearer wore a white satin pages suit.

  Mr. Johnston, the groom, comes of a distinguished Kentucky family. His grandfather was at one time Governor of Kentucky, and one of his uncles was General Albert Sidney Johnston of Confederate fame. The guests at the ceremony were limited in number, but a large reception followed from 8 until 10 o’clock.

  Some of the gowns worn at this reception were very handsome. Mrs. Cox, mother of the bride, was in black Lyons velvet, en traine, the bodice low and entirely covered with cut jet. With this she wore some beautiful diamonds.

  Mrs. Emily Rudy, the bride’s grandmother, wore black duchesse satin, with long train and bodice of cut jet and Chantilly lace.

  Mrs. Given Rudy of Henderson, Ky., was in black chiffon, made low, over black satin, and handsome jewels.

  A few of the guests from out of town were: Colonel and Mrs. Stoddard Johnston, Colonel Preston Johnston and Mr. and Mrs. George Johnston, all of Louisville; Mr. and Mrs. Wheeler Campbell of Paducah, Ky.; Miss Leonard of Paducah, and Mr. Leonard, all of whom have been entertained at the Cox residence during the week. The bride and groom left for their home, 311 Whittler street, which has been entirely furnished for them by Mr. and Mrs. Cox, immediately after the reception. Later they will take a wedding journey.

Mitchusson against Emma Hodge and Willie Mitchusson of the first part and the Said Emma Hodge and Willie Mitchusson of the Second part. Witnesseth, that the Said first party for and in consideration of the premis as well the power vested in him by law and the order of the Court of aforesaid as the division and allotment by the Commissioners appointed in pursuance of the Petition aforesaid. He does by these present for and on behalf of the said Maria A. Mitchusson and Ning Mitchusson her husband convey to the said Emma Hodge and Willie Mitchusson the following lots of ground being the Same in the division of aforesaid. The first lot No 4 is bounded as follows. Beginning it a Stake on Green Street 147 ½ feet from the corner of lot No. 1 and running with Said Green Street S 32 W 54 2 ½  feet to a Stake corner to the Estate of Thomas D. & James Alves Senr Decd thence at right angles with the line between Said Estate 452 ½ feet to a stake in Said line, thence at right angles Said line 542 ½ feet to a Stake thence at right angles 152 ½ feet to the Beginning containing five acres 72 poles and 259 poles square feet.

  The Second or Lot No. 6 is bounded as follows Beginning at Stake 940 feet from a Stake in alley corner to lot No. 13 S 32 W 487 ½ feet to a Stake thence at right angles 240 feet to a Stake in Cemetery lane thence at right angles with Said lane 487 ½ feet to Stake thence at right angles 240 feet to the Beginning containing three acres 10 poles and 60 Square feet. The fourth or No. 16 is bounded as bounded as follows Beginning at Stake 1427 ½ feet from a Stake in the alley and corner to Lot No. 13 thence S 32 W 542 ½ feet to a Stake in the division line between the estate of Thomas D. & James Alves decd thence at right angles with Said line 248 feet to a Sassafras Stump in Said Cemetery lane thence at right angles 542 ½ feet to a Stake in Said lane thence at right angles 240 feet to the Beginning containing three acres 71 poles and 660 Square feet and any the Same lots deeded to Said Second parties by Mrs. Maria Alves Executrix of James Alves decd. To Have and To Hold. Sold Said lots of ground forever with covenant of Special warranty.

Allison comr to Emma Hodge and Willie Mithusson was produced in court and acknowledged in open court by the Said Allison as Such commissioner to be his act and deed, and having been examined and approved by the Judge was ordered to berecorded which with this certificate is truly done

This Indenture made this 20th day of August A.D. 1867 between Young E. Allison comr. appointed by an order of the Henderson County Court in the matter of the petition of Maria A. Mitchusson against Emma Hodge and Willie Mitchusson of the first part and the Said Emma Hodge and Willie Mitchusson children and heirs of Margaret Mitchusson decd of the first part and the said Maria A. Mitchusson wife of Ning Mitchusson Esq. of the Second part. Witnesseth that the said first party for and, in consideration of the premises as well the power vested in him by Law and the power of the court aforesaid, as the division, and attestment by these Commissioners appointed in pursuance of this Petition, aforesaid. Witness by these presents for and in behalf of the Said Emma Hodge and Willie Mitchusson convey to the said Maria A. Mitchusson the following five lots of ground, of ground being the Same allotted to her in the division aforesaid. The first bounded as follows, Beginning at stake in the corner of an alley on Green Street at the present corporation, limits of the city of Henderson, Ky. and running with the line of Green Street S 32 W 524 feet to a Stake, thence at right angles with Green Street 452 ½ feet thence, at right angles 452 ½ feet to a Stake in Said alley thence at right angles 452 ½ feet to the Beginning containing four acres 116 poles and 24 Square feet the other or lot No. 12 allotted to her is bounded as follows Beginning at a Stake 1427 ½ feet from the Stake in the alley and corner to lot No. 9 thence S 32 W 542 ½ feet to a Stake in the division line between the estate of Thomas D. Alves decd and James Alves Senr decd. Thence at right angles 487 ½ feet to the Beginning containing Six acres 19 poles and 119 Square feet and are the Same lots deeded to her by Mrs. Maria Alves Executrix of James Alves decd. To Have and To Hold the Said lots of ground, to her the Said Maria A. Mitchusson her heirs assigns forever with convent of Special warranty.

Comr. Shouse to Emma Hodge

 

Whereas, by an order of the Henderson Circuit Court, duly made at its March Term, on the 23rd day of March 1870- D. N. Walden, Jer M. Priest and A.H. Talbott were appointed Commissioners to make partition of certain lands between Emma Hodge and Willie Mitchusson, and said Commissioners did, in pursuance of said order make partition and division thereof according to Law, in which they allotted to said Emma Hodge two certain lots in the City and County of Henderson, State of Kentucky designed as lots No. 4 and No. 16 and also a certain portion of Lot No. 1 supposed to be one half hereof the said lot No. 1 having been by them divided, and designated in said division as lots No. 1 and No. 2 the last of which viz. No. 2 in said division was allotted to the said Emma Hodge, and all of which are more particularly described as follows viz “Lot No. 4 begins at a Stake on Green Street 147 ½ feet from the corner of Lot No. 1, and running with said Green Street S 32 W 542 ½ to a stake. Corner to the estate of Thomas D. and James Alves Sr deceased then at right angles with the line between said estates 452 ½ feet to a stake in said line. Thence at right angles 542 ½ feet to a stake thence at right angles 452 ½ feet to Beginning, Containing 5 acres 72 poles and 259 square feet.” Lot No. 16 begins at a stake 1427 ½ feet from a stake in the alley and corner to Lot No. 18. Thence S 32 w 542 ½ feet to a stake in the division line between the estates of Thomas D. and James Alves, deceased. Thence at right angles 240 feet to a sassafras stump in said Cemetery line. Thence at right angles 1542 ½ feet to a stake on said line. Thence at right angles 240 feet to the Beginning Containing 3 acres 71 poles and [?]6 square feet. (The partition of Lot No. 1 allotted to the said Emma Hodge by said Commissioners it being designated as Lot No. 2 in their said division, begins at a stake in the line of Main Street and corner to Lot No. 1 in this division thence with the line of said street S 51 W 226 feet 7 ½ inches to a stake in the line of said Street and corner to Rudy. Thence S 59 W 495 ft to a stake corner to Mrs Mitchusson in the centre of Elm Street. Thence with her line N 81 E 256 feet 7 ½ inches to a stake corner to Lot No. 1. Thence with the line of said Lat N 59 W 495 feet to the Beginning And whereas afterwards. viz” – on the 25th day of March 1870 by an order of the said Clerk duly made, the report of the said Commissioner was confirmed and Haydon H. Shouse was appointed a special Commissioner to make deeds to partition accordance with the report aforesaid and of which will now more fully appear by reference to the petition and proceedings there under of Emma Hodge and Willie Mitchusson to be on file in the Clerks Office in said Court. Now this order been witnesseth that the said Commissioner Haydon H. Shouse for and in consideration of the premises and the power vested in him by Law and the order of said Court aforesaid Hereby conveys to the said Emma Hodge the several Lots on parcels of ground above described and allotted to her as aforesaid.

In Testimony whereon the said Commissioner has hereto affixed his hand and seal this 28th day March 1870.
